This seminar will deal with recurring problems in fatal accident cases following developments in case law in the last 3 years. Lawyers continue to face challenges in a field where most agree consensual and co-operative settlement is preferable to contested and uncertain litigation.

This is not an ‘introduction’ to fatal claims, but an advanced seminar dealing with 3 specific issues which in the presenters’ experience give rise to challenges for practitioners. Therefore, the seminar is aimed at practitioners with existing familiarity and some experience with the Fatal Accidents Act and Law Reform Act, however all practitioners are welcome to join us.

1. “Modern families” – how to resolve claims with multiple dependents and families who do not get along.

2. “Inheriting the golden goose” – how to treat dependency when the deceased’s business continues after death.

3. “Pension loss conundrums” – money purchase/ defined benefits schemes – is there a difference as to how they are treated in fatal claims?

We will not have time to deal with ‘first principles’ in the talk, on this occasion.
