The aim of this course is to examine some of the issues that commonly arise in practice when relations between the individuals within a business break down.
Richard Selwyn Sharpe will examine the interim remedies that a partner might seek upon the breakup of a partnership.
David Gilchrist will examine particular issues that often arise when a shareholder seeks to realise his interest in a company by unfair prejudice proceedings under section 994 of the Companies Act 2006.
Stefan Brochwicz-Lewinski will examine the practical steps that a business can take to prevent departing employees and directors from competing and damaging its goodwill.
Workshops led by members of the Group will be held. These will examine particular areas of practice using problems devised for this purpose. Delegates can choose one of the following workshops:
Workshop 1 – Mediation of disputes arising from business break up led by Richard Price and Rebecca Eeley
Workshop 2 – Remedies against departing directors and employees led by Robert Darbyshire and Joanna Vicary
Workshop 3 – Claims and remedies on the break up of LLPs led by David Gilchrist and Laura D'Cruz.
The afternoon concludes with James Fryer-Spedding examining some recent case law in the commercial and chancery field, which is likely to be of practical importance to delegates.
