Ben Morris instructed in landmark case for the insurance industry

Ruling in Dickson v NFU Mutual Insurance Services

Ben Morris was instructed by Browne Jacobson to represent NFU in a two day trial in Carlisle County Court before His Honour Judge Peter Hughes QC. The Judge found that a number of criminal offences may have been committed through Preston firm Barber & Co who were Third Party as to costs in the proceedings. William Hamilton and Beth Caunce review this Supreme Court decision which concerns the correct approach to "uncontroverted" expert evidence, here in the context of a travel sickness claim, but with broader ramifications regarding the procedural fairness of refraining from cross-examining an expert or relying on one’s own expert and waiting instead to criticise that expert’s opinion in closing submissions.
