Ian Denham secures Fundamental Dishonesty finding in Holiday Sickness claim

Ian Denham was instructed by BLM to represent Thomas Cook in a one day trial in the County Court at Worcester, before District Judge Khan. The Claimant alleged that she had developed a gastric illness during the course of her all-inclusive package holiday supplied by Thomas Cook. She contended that the food and drink consumed at the hotel was contaminated with bacteria that had caused the alleged illness.

The Judge found that the medical evidence was insufficient to establish what caused any illness. He went on to find that the Claimant had not been ill at all, placing particular reliance on inconsistent social media posts made by the Claimant.
