Julie-Anne Luck, Chris Kennedy KC and Matthew Snarr staged a mock clinical negligence trial at the European Hernia Society 44th Annual International Congress in Manchester on 20th October 2022.

The trial concerned a fictional case of the patient Mrs Smith who was admitted for an elective incisional hernia repair which resulted in an infection of her small bowel leading to a severe sepsis infection and admission to ITU.

The issues considered in the cross-examination of the hernia surgeons playing the roles of the expert witnesses and the colo-rectal surgeon concerned:

  (1) Informed consent process

  (2) Negligent surgery (causing bowel damage)

  (3) Failure to subsequently identify the injury and/or re-admit the patient for surgical investigation.

The mock clinical negligence trial was followed by an in-depth discussion by the barristers and consultant surgeons as to the standards of care involved in hernia repair surgery with audience participation from the many hundreds of medical delegates present.
