Travel Law - Gerard McDermott KC - 6th July

Gerard McDermott recently appeared in the High Court in London in a case which concerns the temporal effect of the Rome II regulation. It is one of the first cases to reach the High Court and will be important in determining whether foreign law or English law applies to the assessment of damages for personal injury in EC countries for English tourists injured abroad who bring their action in the English Courts for injuries sustained between August 2007 and January 2009.
